Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the WorkCheck service (the “Service”), operated by Summerhill Technologies (“WorkCheck”, “we”, “us”). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at hello@workcheck.app if you suspect any unauthorised use.

3. The Service

WorkCheck provides task management tools including task creation, assignment, deadline tracking, reminders, team dashboards, and optional WhatsApp notifications. We may add, modify, or discontinue features from time to time. Beta features are clearly marked and may change or be removed without notice.

4. Plans, Fees, and Payment

Certain features of the Service are available under paid plans. Fees, billing cycles, and applicable taxes are shown on our pricing page at the time of purchase. Unless stated otherwise, fees are non-refundable and you authorise us (or our payment processor) to charge your chosen payment method on each renewal until you cancel.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms;
  • Upload or distribute malware, spam, or harmful content;
  • Attempt to gain unauthorised access to any account or system;
  • Reverse-engineer, scrape, or resell the Service without our written consent;
  • Use the WhatsApp integration to send unsolicited marketing messages;
  • Infringe the intellectual property or privacy rights of others.

We may suspend or terminate accounts that violate this section.

6. Intellectual Property

WorkCheck and its licensors retain all rights, title, and interest in the Service, including all related software, designs, and trademarks. You retain ownership of the content you submit to the Service (“Customer Content”). You grant us a limited, non-exclusive licence to host, copy, and transmit Customer Content solely as necessary to provide the Service.

7. Third-Party Services

The Service may integrate with third-party services (for example, WhatsApp Business, identity providers, or email delivery). Your use of those services is governed by their own terms. We are not responsible for third-party services beyond the integration we provide.

8. Confidentiality

Each party agrees to protect the other’s confidential information with at least the same care it uses for its own, and to use such information only for the purpose of performing its obligations under these Terms.

9. Warranty Disclaimer

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, WorkCheck will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, even if advised of the possibility of such damages. Our total liability for any claim arising out of or relating to the Service is limited to the fees you paid to us in the 12 months preceding the claim.

11. Indemnification

You will indemnify and hold WorkCheck harmless from any claim, demand, or expense (including reasonable legal fees) arising out of your use of the Service, your Customer Content, or your breach of these Terms.

12. Termination

You may cancel your account at any time from your settings. We may suspend or terminate your access immediately if you breach these Terms or if we are required to do so by law. Upon termination, your right to use the Service ceases and we will delete or anonymise your data in accordance with our Privacy Policy.

13. Governing Law and Disputes

These Terms are governed by the laws of India, without regard to its conflict of laws principles. For users contracting from the UAE, you may additionally rely on mandatory consumer protections under local law. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New Delhi, India, unless mandatory local law requires otherwise.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or in-app and update the “Last updated” date above. Continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
